In an interview with Phil Salewski, lawyer at the IT-Recht Kanzlei, we get to the bottom of the innovative concept of the firm:
Mr. Salewski, would you like to introduce yourself to our readers first?
I am a lawyer at IT-Recht Kanzlei München and, as a member of a team of 8 lawyers, specialized in data protection and competition law. My clients are mainly entrepreneurs with a focus on eCommerce.
Since 2019, I have been taking care of the legal concerns of the clients as well as the cooperation and partner management of the law firm. Thus, I am in a lively exchange with shop software companies, hosting providers and agencies.
What is IT-Recht Kanzlei München?
The IT-Recht Kanzlei is a Munich law firm founded in 2004, which advises entrepreneurs of all types and sizes in the areas of eCommerce and competition law. The object of the legal work is in particular the provision and maintenance of professional legal texts for online trade within the framework of permanent trader support. More than 30,000 active clients make the IT-Recht Kanzlei one of the largest providers of legal services in Germany in this field.
What are currently the most important issues for website operators or online traders?
One of the most important, if not the central issue for website operators is protection against warnings.
Warnings are legal reprimands issued by direct standing competitors or associations, which criticize illegal behavior on the part of the website operator and are accompanied by a request to refrain from such behavior in the future. Warnings bear a high cost risk because the warning party can charge the lawyer’s fees for a well-founded warning to the warned party, and there is also a risk of consequential costs (either court costs or contractual penalties in the event of the submission of a declaration to cease and desist with a penalty clause following the warning notice).
In this case, Website operators can only protect themselves purposefully if they convert all legal obligations imposed on them duly. This concerns above all, even if not exclusively, the provision of law confirm legal texts.
How can one protect oneself from these dangers with the help of IT-Recht Kanzlei?
IT-Recht Kanzlei effectively supports website operators in the legal protection of their online presence by providing and maintaining professional legal texts, which build the base for a warning-proof online presence and implement the elementary legal obligations. Valuable accompanying materials such as instructions for action, assistance, samples and a warning ticker complete the offer and support website operators also beyond the legal texts in the legally compliant design of their websites.
Where can this be done and what does it cost?
IT-Recht Kanzlei offers eCommerce traders (whether they sell their products in their own online shop, on trading platforms or on social networks), suitable warning-proof legal texts starting from 9.90 € plus VAT per month.
- General business terms and conditions
- Cancellation policy
- Site notice
The package includes a legal maintenance service which ensures that legal texts are legally compliant in the long term. Over 80 models and instructions for action complete the package of legal texts.
The legal texts are also suitable for small businesses and can be used on any number of identical presences of the same company.

What are the main areas of service, what makes the law firm special?
IT-Recht Kanzlei München specializes in providing professional legal texts for distance selling of physical and digital goods and offers clients the provision and maintenance of general terms and conditions, data protection declarations, cancellation policies and more at favorable and flexible conditions.
The IT-Recht Kanzlei stands out from other providers on the one hand due to the special quality and warning security of the legal texts provided, which are prepared and continuously updated by special lawyers. This guarantees clients the best possible legal security for their sales activities.
On the other hand, the IT-Recht Kanzlei München convinces clients with innovative and user-friendly service solutions: via a central client portal, clients can not only manage their legal texts individually and, thanks to special software components, tailor them in detail to their own business activities, but also set up an automatic data processing system that ensures the automatic direct transfer of the legal texts and their updates to the corporate website.
In this way, entrepreneurs are considerably relieved of the burden of legally securing their presence and have more time to concentrate on the essential, namely their own business.
Finally, in addition to the legal texts and at no additional cost, the IT-Recht Kanzlei provides clients with an extensive and extensive information database with numerous instructions, samples and legal notes, that is constantly expanded and provides answers and assistance to all common questions and problems of eCommerce law.
Since when has this business model been pursued and what has changed during this time?
IT-Recht Kanzlei has been providing professional legal texts for eCommerce with legal maintenance services since 2005. What began as a self-experiment has developed over the last 15 years into a service concept with a constantly increasing demand. Since the start of the business model, especially the service portfolio and the technical solutions have changed significantly. While the service was set up at that time to provide its own online shops with legal texts, IT-Recht Kanzlei now also offers tailor-made solutions for all common sales platforms and social networks as well as for special service areas.
In the course of time, due to the changing legal situation, the content and scope of the legal texts offered have of course also changed. One example is the General Data Protection Regulation (GDPR), which came into force in 2018 and had a significant impact on the necessary content of data protection notices for websites. In addition, there has also been a constantly expanding range of foreign-language legal text solutions for international business activities.
In addition, the client portal as the central user interface for clients has been adapted to the technical progress in the digital sector and enriched with modern intuitive operating and organizational elements. Finally, IT-Recht Kanzlei was able to significantly expand its data automation solutions and now offers data interfaces for almost all common shop hosting environments.
How did the idea come about and why does it work so well?
The idea for the business model was largely influenced by the consolidation and development of European consumer law and also its dynamics. New information obligations as well as new consumer rights forced online traders to include extensive legal information on their websites in order to avoid warnings. With this background, offering individually prepared legal texts in return for a generous lawyer’s fee no longer seemed practicable for two reasons: on the one hand, legal texts prepared in this way ran the risk of becoming outdated within a few months and no longer taking adequate account of the dynamically developing consumer law; on the other hand, horrendous lawyer’s fees often prevented promising business ideas from being realized.
The idea of a cost-effective and flexible legal text model with an update service for continuous actuality and warning security was born.
